My son signed a one year contract at (a gym). After the year was up they automatically renewed his contact. He had been trying to cancel it unsuccessfully for 6 months. He sent a certified letter they say they never got. He went to the gym and was told he owed 60 dollars and when he paid it his membership would be canceled. The following month the money was still taken out of his account. He went back to the gym and a very rude manager made him wait for over an hour, came back and told him he was all set. His membership was canceled. I advised him to call the corporate number to confirm this. He was told it was not canceled. They told him that because it is an independant franchise they could not help him. They said he has to deal with the gym he belongs to. He feels trapped and taken advantage of. Meanwhile they are still taking 60 dollars out of his account every month and he has never used him membership. Not even once.
Does he have any recourse? How can he end this contract. Any advise would be greatly appreciated.

Thank you,

Did your son follow the requirements in the contract exactly re cancelling membership? Someone else may come along with some suggestions for you/your son.

To mrswoof304:

Was your son at least 18 years of age at the time he allegedly signed (or was said to have signed) the contract?

Bally's has a very oor reputation. Read the information on these links, if you wish to learn what Bally is alleged to do to people:

You can also contact your state's attorney general. He might be able to help.

Or, NY state consumer affairs:

Good luck... as you'll discover this organization is very persistent.....

How are they making the transaction?
If by credit card contact the issuer and dispute the charges.
If a direct withdrawal from the bank contact the bank.
Read the contract and follow cancellation instructions.
