About 3 years ago I signed up for a 30-day trial at a well-known fitness giant. The employee that helped to sign me up would not sign me up without a credit card on file. He stated that I would not be charged during this period and if I chose to accept the membership after 30 days, I would then be charged.
I had heard about the offer through my job in King of Prussia, Pa. At the time I was living in Delaware (outside of the radius of the fitness club's contractual reach). The employee used my job address to sign me up for the trial and had me sign what he told me was a 30-day agreement.
I never returned to the facility after that day. I called about 3 weeks later to make sure that my credit card would NOT be charged b/c I was not interested in a membership (due to my distance). The woman that helped me told me that I could not be found in the system (even after giving her my credit card information, name, address, etc.). She informed me that I could not be found as a member at all.
Taking her word, I went about my life until my account was overdrawn about 7 months later. I realized that the fitness company had been charging me $70 each month! I had battled them for an additional couple months, writing two letters, PLEADING with them to discontinue charging my account! I wrote a letter to my bank stating to no longer accept these charges.
I called to discuss this with the company and they agreed to no longer charge me unless I sent something in stating that I lived out of state at the time. I complied, thinking everything was said and done and now I'm being sent to a collection agency for over $1500. The fitness company now claims they never received my proof of living out of state and refuse to do anything about this. And after a recent conversation with one of their employees to follow up the matter, they claim I signed a 36 month contract!!! Infuriated, I let the woman know I NEVER agreed to a 36-month contract and that their employee convinced me that I was signing up for a 30-day TRIAL period!
Is it possible for me to take them to court to remove this? I have NEVER used their facility and I was deceived TWICE by their employees! This isn't fair and I have researched COUNTLESS experiences by other people with the same company.
