We are renting a house in florida and after 8 months have discovered a case of mold!?
We had a mold concern when we first moved in because of a mildew smell (house had been vacant for sometime because they were trying to sell it). We brought this to the Property Mgmts attention after we moved in (when we discovered it) and all they did was place a drying agent under the carpet where we thought we found mold, then they placed the carpet back over the area and caulked it! Well...a week ago in our bathroom (mst bath of mst bedroom where mold has always been suspected) the soap dish just fell off the shower wall with NO INDICATION it was loose! It was dark green and black behind there...dish was just attached to drywall. Tiles around area are loose. We decided to research mold and buy testing kits. Well we have noticed puffy spots under the latex paint in the bathroom as well and so we peeled paint back to discover black fuzziness! GROSS!!! We tested both areas and the air for spores and both kits grew mold in UNDER 24 hrs!!!!!! We also discover a leak that is coming from the exhaust fan in the mst bath. There was an issue with the fan when we moved in so their maintainance people couldn't fix it and just disconnected fan. The analysis of what kind of mold this is will take 3 weeks and $80 and I sent a letter with photos to the Property Mgmt via DHL which was signed for and received 7/11. What are our rights?! We want out, especially since we have a 2 year old and a 5 month old who still sleeps in that room with us. The 5 month old has been sick for 2 weeks and not getting better. She is worse when in the room for a bit. I have a migrane every time I spen a good amount of time in there and my husband is congested and has a sore throat as well when in there for a while. What can we do??? We want out of the lease. I know they received the letter bc I have confirmation....they had all day to call and never did on Friday! PLEASE HELP!!!! How long do they legally have to respond and fix the problem? Can we withold next months rent? THANK YOU!!
