What is the law on an employees anniversay date upon returning from their FMAL leave? Is it at the discretion of the employer whether or not the employees start date remains the same or is pushed back by the length of time that they were out?????

It depends on how they manage the anniversary date for employees on non-FMLA leave.

Whatever they do for employees on non-FMLA leave, is what they have to do for employees on FMLA.
