If a company that I worked for had two different companies that together had more than 50 employees and thus had to give FMLA benefits under federal law due to the joint/integrated business test. One has since been bought out and the other company is now below 50 employees. Is the company that is below 50 employees that is now an independent firm still required to provide FMLA benefits? I'm just looking for clarity on the matter.
 
Depends on how long ago the company was bought out and for how many weeks last year there were over 50 employees.
 
The FMLA applies to all:
public agencies, including local, state, and federal employers, & local education agencies (schools); and
private sector employers who employ 50 or more employees for at least 20 workweeks in the current or preceding calendar year - including joint employers and successors of covered employers.
