I worked at a restaurant I was caught stealing a plate of food I gave the food back and was fired but the owner said he was going to file a report what legal action should I take

If you're arrested (HIGHLY UNLIKELY), admit to nothing and simply verify yoru name, age, date of birth, address, and announce that you want a lawyer and have nothing more to say.

In the meantime, stay away from that garbage can posing as a restaurant.

I very seriously doubt the owner will file a police report over a plate of food but you never know. If he does & you are arrested, do as army judge suggested & get a lawyer.

I am surprised at AJ's characterization of the restaurant, however. Is he suggesting that the restaurant was out of line for firing a self-acknowledged thief?

If you've read any of my posts, you'd know I support an employer's right to terminate.
I just don't want the OP to ingest food unfit for human consumption.
Hence, I admonished OP to avoid garbage cans posing as restaurants.

Sometimes I don't understand you, my friend.

No worries, I'm a lawyer. But, I've been the rebel all of my life. Despite that, it befuddles my wife, too.
We just attended her family reunion this past weekend.
She said, "I don't understand why everyone in my family likes you."
Those are the times I just grin. I like words, God knows I'm verbose, I also know when to STFU and grin.
I'm grinning now, my friend. :)

You take no action until they do. If they have no video or confession they lack proof and DA will not take case. If they do file a criminal complaint you answer no Police questions without an Attorney present. You give your name and request an Attorney as per your rights. that should cease all questioning. If not any answers cannot be used in court but regardless you answer no questions.
