I was a GM for a restaurant in Kansas. My ex employer created a 30 day PIP plan that never presented to me. The date of that document was April 13th. The employer forged my signature on the document. I received a " final" warning on April 21st and was terminated on May 5th for reasons that they are completely not true. I had no idea about the PIP until I received it from the unemployment office. I was denied benefits.
I talked to 3 attorneys here in Kansas. They all said they can not(want) help. Since there is no discrimination case? there is nothing they can do. That was everyone's answer.

I can not believe that the employer can be hold accountable for forgery.
Anybody out there could help?

Your problem, among many, is that its YOUR word against THEIRS.
You are ONE, they are MANY.
Be very careful when accusing people, and companies of committing crimes, FORGERY for example.
You can't PROVE it, you're simply DENYING it.

If three licensed KS lawyers say you have NO case, seeing 300 more won't change the answer.

The employer didn't have to create a reason to terminate you.
They didn't have to offer you a PIP.

The appropriate management person could have simply walked up to you and said, "We're terminating your employment immediately. Here's your final paycheck. Please leave, now!"

Yes, its that darn simple, and uncaring. Smart employers do it that way.

Your challenge is to PROVE the employer conspired, crafted a ruse of a PIP, forged yoru signature, and subsequently terminated you.

The employer will ask you, prove you didn't sign the form. By the way, you need not sign a PIP. The smarter play for the employer was to have PRINTED the words, "EMPLOYEE REFUSED TO SIGN" on the signature line.

I don't know why you were denied unemployment ins. benefits & don't know what the PIP noted but generally if you are denied UI, you can appeal.
 
This isn't forgery as the law defines it. Either way, whether they had a written document or not, they could legally fire you. That someone signed your name to this legally unnecessary document doesn't change the legality of firing you. Neither does this mean you are entitled to UC. The fact that 3 lawyers already told you this should tell you something. Appeal if you want and present your side of the story but getting hung up on whether or not you signed the document won't win you benefits.
