My mother-in-law just died and had given her friend power attorney, but we do not know what type. We do know that the power of attorney is only for the living. She has told us that mom has a will and then doesn't and now again she does. She told my husband that she would bring it to the funeral home on 6-24-11.
She did not. She has given numerous items away and she herself has approximately 10,000 worth of jewelry. We have no clue regarding her bank account, SS, credit cards, or the status of a safe that has been removed from the home. She also has her car with a signed title. There are 4 siblings and they do not know how to proceed. Also, we do not know the date that this was supposedly signed and things given away,
since her dementia had become severe in the last 90 days.

You should speak with a local attorney.
You need time to grieve.
Let the attorney handle the dirty work for you.
Please accept my condolences on the loss of your loved one.
Retain an attorney, ASAP, and grieve your loved one's recent passing.

Find a probate attorney to handle this. An attorney can help to put a stop to the distribution of property until a will can be reviewed, if there is one. This is not something you will be able to handle on your own.

Thanks moose for your reply. I do have one other question. The children don't want "to stir things up" with this "friend", but what happens if they don't want to find a lawyer to handle this?
