Drug Crimes, Substance Abuse Friend in trouble with Marijuana

My jurisdiction is: Montana

My main question here is that, can you be charged with anything if you are in the same house when it is searched and marijuana is found?

What had happened was my friend was over at one of her friend's homes, and she noticed an odd odor but didn't know what it was. Later on the police showed up, searched the place and found some marijuana. Just recently she has been given notice to appear in court. She was told by the police officer who gave her the notice when she asked why she was in trouble when she had done nothing wrong the officer said, that because she was in the same place she could be charged with a crime and worst case scenario get under a year jail time and a fine.

She has a clean record, is doing well in college, and jail time would mess up her schooling big time. Is there anything she can do to avoid potential charges, or can they even charge her with anything? Thank you for your time.

A: Yes. It's called constructive possession. You need to hire a lawyer ... yesterday.
 
This all matters a great deal as to the location of the "crime."

Regardless, it'll save you money in the long run to follow seniorjudge's advice and get an attorney.
