Friend not making car payments

Hi, after my girlfriend and I split up on friendly terms, she moved back to texas.

She agreed that if she could take one of the cars (registered to me, loan in may name), She would send me the 200 a month for the car payment and eventually work out a loan in her name so we could transfer the title to her (and take me out of the loop).

She has since not sent any money and will not return my calls, it's been 6 months.

I know I could go get the car back, but I'm in VA and she is in TX.

Is there any legal action that I could take without going to Texas? I would either like the car returned at her expense, her to make the payments our flat out buy the car from me.

I'm sorry to hear about your problem but... wow... you didn't see this one coming?

If she borrowed your car and refuses to talk to you and refusing to return it, have you left her a message that you might need to inform the police that she has stolen your car? There is no simple way out of this and, if you haven't figured this out, it will get ugly thanks to her misconduct.

Small claims will likely require you to go to Texas. Filing a case locally would be more expensive, you'll need to indicate that what the transaction is and why she is under the local court's jurisdiction, and then you'll have to try to locate her and having her served. This is likely a more expensive proposition. Best of luck...
