Four years ago I had a new furnace and air conditioner installed. The following summer and every summer since, whenever the air conditioner came on water collected on my basement floor.

In Feb. 05 I signed a service contract with the contractor to inspect the system twice yearly for a payment of $16.99 per month.

This summer when the water appeared again, I called a different contractor who found the furnace was improperly installed. The original contractor reinstalled the furnace based on MY instructions, from the information I received on the second contractors finding.

When the air came on again the water continued. I called in the second contractor to fix the problem and he did. The contractors "trained technicians" did not do the job properly.

The original contractor reimbursed me for the costs.

My problem is that I believe the original contractor did not live up to his written agreement. It says that "my technician is not only trained to care for your equipment, he is trained to care for you and your home."

How can a trained technician inspect the furnace for 3 1/2 years and not know it was installed improperly/

The amount I paid over this time was $899.41.

I feel this is a breech of contract and I have tried to get the original contractor to reimburse this amount due to his not living up to his agreement. He says i received value from the inspections. I disagree.
 
I don't disagree with you. I'd argue that you've had to get several repairs and deal with a second company due to their negligence. As of right now, nobody has been paying for your time and inconvenience, all of which could have been avoided had the originally company done its job properly. If it were me and they didn't recognize this, I'd let them know that if they don't pay the money you'd go right to court and will likely have no problem at all getting a judgment. Just IMHO and let us know how this turns out.
