Can a Social Security or a pension be garnished by a judgement from a credit card company? My husband is retired and his only income is ss and pension. He recieved a certified letter from a lawyer representing a credit card to go to court. If my husband cannot pay this, can they garnish his ss and pension income? I do not work at all so that is the only income we have. I am not old enough to draw any kind of pension or ss. Thanks

No SSI is exempt, I am not sure about the pension-- I do know they may garnish a bank account -- If you can prove the money is from the SSI the will have to remove the hold

Your local court probably has all the forms you need online, but if not you can go down and pick them up for free. They have a complete list of exemptions and the number for the law so you can quote the exact correct info when you fill out a claim of exemption form. I just beat two different collection attempts and garnishment of wages for both of them as well as one attempt to garnish my bank accounts which are protected under the workers compensation income exemption law.
