Get Out of Sign On Bonus Repayment

My brother accepted a job to work for a US multinational to be based their China office. He received a $50k sign on bonus. But, now he wants to leave the company because it is too stressful, political and not getting the opportunities that he was verbally promised. What can he do to not repay the $50k. He would have to stay untill Oct 2011 for the first $25K to vest and Oct 2013 for all $50k to vest.

1) He is set on leaving and would like to keep as much of the bonus as possible. What should he say, if they try to offer him another position?

2) If HR force him to return all $50k:
-can he just threaten that he'll stay and work at half the efficiency?
-how about suggesting that he'll hire a lawyer?
-what's a good way to negotiate?

He can quit anytime he wants.
The Chinese, unlike the Saudis, don't keep your passport as collateral.
If he wants the first $25k, he will have to stick it out until the fall of 2011.

I don't see any room for negotiation with him in this economy.

I don't see how a lawyer could help him.

Talking to a lawyer couldn't hurt.
