Okay so I would like to have custody of my two nephews whom are 13 and 15. They have gotten into a little bit of trouble with the law lately and I do not believe that my sister nor her ex husband have the proper parental tools to raise them any further. My sister and her ex both have had many encounters with the law due to drug use. My nephews have been removed from the home several times by the CPS just to be returned home within a few days or within a week. As of now, my two nephews are in joint custody of my sister and her ex. Her ex has them mon-fri and at my sisters on the weekend... but lately they have not been at their mothers because her and her current boyfriend have been fighting non-stop due to the fact they are always intoxicated.
Their father does not seem to care about my nephews.. he does not keep a steady supply of food in the home. He spends all his money on drinking at the bar and comes home in the wee hours of the morning drunk and unhappy with the two boys. He will belittle them and make them feel guilty with they way things are in their lives. When he buys them presents he makes sure to make a point how much hard work he put into getting them their presents. (especially around the holidays and birthdays) He will leave them home alone for days at a time without a proper amount of food and clean clothes while he is gone. I believe that the way my two nephews have been raised has contributed to their behavior. They do have good grades in school but the are on probation for vandalism which they are serving community service for as of now, but they recently (two days ago) were caught smoking by an officer while they are on probation. They could be taken out of the home and put into foster care. This would prove to be benificial to us considering we could offer family placement, though there is only one thing standing in our way. I am a lesbian whom is openly out and married (in a different state) to another woman... Nebraska does not like Gay parent fostering(we have tried with another niece of ours and was deined because we are gay) The difference between the case with my niece and the case with my nephews is age, my niece was 6 mo. old and my nephews are both teenagers. My nephews have both openly admitted that they would prefer living in our home and hate being at either of their parents homes. Both of my nephews have shown inprovement when that are in our home. They do not argue with us, they keep clean up after themselfs and make sure they have their homework doen to show us. We buy them clothes and help take care of them... their is only soo much we can do though when they are only at our house once a week. I am afraid that if we take my sister and her ex to court that they are going to use my sexual orientation against and they might win... and known my sister and her ex is they found out that we were trying to get custody of my nephews they would not let us see them anymore which will cause them to act of even more.
I know that my nephews are only acting out because they crave love and attention from a stable home which I know that my partner and I can provide them. I know that their behavior can only get BETTER from being in our home. Please can someone tell me whether I have a case or am I just wasting my time and risking ever seeing my two nephews again.
