Getting my appraisal fee taken and not getting it paid back

I have been waiting for six months to find out if my offer on my house was approved or not, it started out trying to go through as a short sale, and then was sent to the bank for a foreclosure, without me knowing anything about it. I have been waiting and being kept in the dark this whole time, and just a month ago was told my offer was accepted and we could close in about two weeks! I was so happy, I was willing to do whatever needed to be done, to further speed up the process. I was told that my lenders needed to order an appraisal and needed to collect a $400.00 fee from me to order it (this was on a Monday). Then I called her back on Tuesday to see if it was going to happen this week, so we could finish this up, and was told that it would take about a week to process, so it wouldn't be done until next week. On Friday of that same week I recieved a call from our lender explaining to me that she didn't know who or how I found out that the offer was accepted, but it was denied, and the appraisal had already been done and the money was going to come out of my account for the appraisal and there was nothing she or the bank could do to refund me the money. The money came out of my account on that Saturday (after I talked to her), and she explained that no matter what, even that we were not getting this house, they could not refund us the money. Do I have grounds to stand on to get this money back?

A: No; the appraiser did the work for you and must be paid.
