Getting Security Deposit Back

My security deposit was $800. I was evicted with a nocause eviction. I had 30 days to move out and I did. I feel I left the house as clean as when I moved in, I even took pictures and had family walk through and make sure all was well. When I got my security deposit refund it was for only $275. I was charged 8 days of rent because when the 30 days was up it was 8 days into the next month. So, $206 was witheld for that. The rest was witheld for cleaning. The land lord himself was the one who did the "cleaning" (his wife owns the appartment complex) and say's it took around 20 hours to clean and he charges $16/h for labor = $319. He sent, along with the check, a very vauge summary of what was done("Cleaning and restoring activities included working on the shower doors,bath tub,cabinets,mirrors,doors...... Subtotal $319). I called him and asked for a detailed description of what was done and why, and asked for any repiepts, he refused, he then tried to negotiate a new amount with me as appossed to going to small claims court. He admitted to me on the phone that I left the place in good condition. What I was wondering was, can he charge me for the 8 days rent? I was still living there up until the last day of the eviction. Also, when this goes to court, which it will, since I have pictures and witnesses and he has no pictures and only his word.....what might my chances be of getting back the rest of the $800? You owe the rent if you stayed into the next month and you actually owe for the ENTIRE of the next month depending on your state's statutes. You should have had your exit walk-through with your LANDLORD not your FAMILY.

He may well have pictures as well as other evidence as to the condition when you moved in and when you moved out...you may be better off to take his offer and the additional monies he offered be refunded.
