Without going into to much detail, I resigned my previous job under pressure of termination because of a positive on a DOT mandated drug screen. Only part of my job was a safety sensitive position and that is the reason I was given the option to resign. I had 11 years with the company and never had any discipline problems and thats why I think I was given the option to resign.

My questions are as follows:

I was told by company officials that if I resigned they would only tell future employers that I was a good worker. I know I am hoping for them to act in good faith but can they really not tell future employers nothing about the drug test? I will not be seeking a safety sensitive so the DOT positive test shouldn't be an issue ( I think).

Also will the positive show up on a normal background check that is not for a DOT position?
 
There is no such thing as a "normal" background check. There are as many types of background checks as there are employers. What shows up depends entirely on what the employer asks for and how deeply they delve.

We have no way of knowing if your employer will divulge the results of the drug test or not.
 
I guess my guestion should have been, is it legal for my ex-employer not to tell any future employers that I tested positive?
 
As long as it's for non-DOT positions, yes, they may legally withhold that information.
