hello hope there is a lawyer out there that can tell me who will take my case..
i have applied for employment at numerous jobs and everything looks fine until they get my former employers statement. a former employee check. once they get that back they say were sorry we cant hire you
so i took it on myself to find out what the former employers are saying so i made up a truckline name and sent in the same paperwork others would send in.. when i got them back one of them said i abandon the truck. so i called that former emploer up and asked them why are they putting that on me. they said well in iowa you left the truck. and we had to come and get it.

i then said i was rushed to the hospital by ambulance . the dispatcher was called and told my girlfriend to get the truck to the nearest truckstop needless to say she couldnt drive but a officer who had a cdl parked the truck at the truckstop.

i had kidney stones and the emergency doctor said i couldnt drive until these stones has passednow we ended up calling my girlfriends mother who came over 200 miles to get us i was on morphin. so i did not abandon the truck it was a medical that i had to leave the truck. (false infomation my former emploer is giving to other jobs i am trying to get.

i said you cant put that on me for a medical reason and the dispatcher knew what was going on. now i am having a hard time getting a job because of this. i talked to one lawyer and he said yeah u have a case but i dont have the time to do it. is there anyone who might know of a good employment lawyer whho would take this case?

Google them for your state. YOu don't have to have one from the same town or county. You can get one from anywhere in the state. I doubt there will ever be a hearing if you take action, they would settle out of court.

From your employer's perspective, the information they are providing is true. They DID have to come collect the truck. The fact that you had a medical reason for "abandoning" the truck does not make it untrue information.

Before you try a questionable lawsuit, may I make an alternate suggestion?

Tell the prospective employer, up front, what happened and why. Give them your perspective of the incident before they have a chance to hear it from your employer. That way, they'll already have the details and it will be less of a "slap" when they hear the employer's version.

Often, it's not what happened but the way it is first presented to an employer that matters. Prospective employers don't like being blindsided. If they already know what happened from you before the employer has a chance to give their side of the story, they're much less likely to hold it against you.

Take it from someone who has been hiring and checking references for a great many years. ;)

cbg thank you for your info on your opinion and i did what scooterdog said and a lawyer called me and i told them the the situation and they said sounds like a defamation of character and they are going to take the case so. somethings are legit and medical reasoning when the company knew and said to leave the truck and they would come and get it. but i want to thank you for your input i will keep you all informed of what hppens if you like. but as well as that goes i had no clue what the former employer was saying and i was going thru a recuiter who has x amount of companies he deals wiith so with that i had no clue tht my former employer would say i abandon a truck until i heard from him which he heard from the new emplyers if that makes since now that i know what was said and have proof of it not only by hear say but by it writtin on paper that was faxed back to me and plus the person themselves told me the same thing of why they said i abondon which was the incident when i was rush to the hospital believe me if i would f known that is what they was saying i wold of still called my former employer to find out why tell them to stop putting that false info and still hire a lawyer.

If you've got a lawyer who thinks he can make a case from this, fine. But it's not going to be settled tomorrow or even next month, and you still need to get a job. So I suggest you still take the method I suggested while you continue your job search.

As long as you understand that what the ex-employer is telling about you is indeed true and that you will lose the case, then feel free to enrich this lawyer.

How are you going to pay him?

oh cbg i agree and i did tell any other employers about what the company will say and explained to the what happened. so i do agree with u there i will cover my bases.
and seniorjudge just because the company may think what they say is true doent mean its TRUTH. i have to prove what happened with medical records and witnesses that was there i can prove my intension was not to abandon the truck. doctors orders says i cant drive now if i was to abandon the truck i was 200 miles away from where i live i would of went there and dropped the truck off but even though u dont know me i can say i would never abandon a truck. i been driving over 20+ years i have worked for some rotten companies and still didnt abandon any truck .but as i said i will keep u all in formed of either how the case is going or how it finished out.
