My father-in-law recently died leaving some property to my wife. Upon reviewing the deed to the property we discovered another man's name (deceased) on the title. This property was purchased back in the 40's when they were business partners in coal mining. This gentleman died about 10 years earlier than my father-in-law, who has been paying the taxes from the initial purchase on this property all these years himself. My first question is why was not this property discovered when this gentleman died when they do a title search on deceased people? If this property is not considered jointly owned, how do we remove this gentleman's name from the deed?

A: You don't remove a name from a deed. But you can go in and quiet the title to the real estate. It sounds like pa has a pretty good case for that (which will tack on to your wife).

You need a real estate lawyer.
