Grand Theft Auto in Texas

About a year ago my husband's boss offered to Co sign for him to get a truck, we have been struggling for money and about 3 months behind on the payments. He's been keeping the financial company up to date and making small payments here and there to try to get coug up. The man that Co signed for him has been sending him texts saying that he's being charged for grand theft auto and he's gonna put him in prison and alot if other threatening messages. My question is, is he able to do that being that he's the cosigner and my husband name is on it too, and what should we do to resolve this. We have already called the finance company to tell them to come pick up the truck cause we're no longer get able to afford it.

Not if it was given willingly. He should offer the vehicle to the guy first. Otherwise the loss from repo, auction and sale is going to be expensive. If he has the vehicle, he can arrange to sell it, depending on how it is titled would need to be worked out.
