My Grandmother passed away several months back and now my mom and her sisters about to meet with the Probate Judge.
The first issue is that one of the children took my Grandmother to a Paralegal/Notary in 1992 and had a will drafted, naming her as the Executrix and leaving almost the entire estate to her.
Originally, there were 5 children; one was murdered 22 years ago. I feel that each of the surviving children and the children of the deceased should share equally in the estate.
Another issue is that when my Grandfather died, he did not have a will to identify how his possessions should be disbursed. There are many of his family possessions that he expressed verbally while he was alive for each of the siblings to receive after his death, but they were never given to the children.
I told my mom that the right thing to do was for the 3 children who want to do the right thing was to ask the judge for the estate to be split equally, 5 ways so that the living children as well as the children of the deceased sister could be included in the disbursement of the estate rather than just one "greedy" sibling.
What can be done to stop this "Executrix" from running off with the family memories and selling them for her own personal gain?
I really think that is what my Grandparents would have wanted.
