Half Owner, served an eviction...Possible?

To attempt to make a long story short...
My fiance's father passed away over a year ago and him and i have been living in the house his father willed to my fiance and his older brother(executor of the estate, and currently not living in the home) since april. in the last will and testament it clearly states that all belongings are to be split between the two children 50-50. i recently found out the the brother (executor) has transfered over the title to the house (which is totally paid off) solely into his name completely leaving out my fiance. Then...he serves me eviction papers that says "pay rent due of $0.00 or get out". we have never signed or made any verbal aggreement upon rent or anything upon living there except to keep up on monthly bills, which we have. Is there something i can do to prevent being kicked out of a home by someone abusing their executor authority and not following the last will and testament?
