I am not quite sure if this is the right forum to post this question, but here goes:

A friend of mine, Chaz, is involved in a custody dispute. The mother's father, Fred, has chosen to involve himself. They have tried on numerous occasions to have him charged and/or arrested on various false allegations. Most recently, our landlord brought to our attention a letter he received from Fred in which Fred has compiled information from past landlords about judgements against my Chaz. He is encouraging the current landlord to evict Chaz. He also encouraged the new landlord to join in a joint lawsuit he is trying to arrange against Chaz pursuant to these issues he already has judgements against him for. What are Chaz's rights in this situation? Should he merely file a harassment restraining order, ask for a cease and desist order against Fred, or can he actually file charges and sue? If so, what charges would he be citing on the cease and desist order or filing for in the lawsuit?

Chaz may have a possible action against Fred.
In order for Chaz to prevail, he must be able to prove what Fred has done, not merely speculate.
If Chaz has an action, it could lie in the form of a couple old common law torts; libel, slander, defamation of character, tortious interference with business or livelihood. and/or some sort of civil conspiracy.
Please advise Chaz to speak with a couple of local attorneys and see what they have to say relative to Arizona civil law.
Chaz would be wise to avoid pursuing this in small claims court.
Why?
A case brought in a true court of record will inflict harsher penalties against the alleged transgressor(s)/conspirator(s).
