Harrassment at school!

I live in a small community in Northeast Nebraska. My three children are enrolled in a small class school. Just a week ago, my youngest, a kindergartener, was harassed by a janitor in the school. He accidentally threw a fork away, which the janitor grabbed out of the trash, and brandished in my son's face. This janitor is a sloven, unshaven, hulk of a man who is known for his gruff behavior and inappropriate language. I of course complained to the principle who would then talk to the superintendent. They talked of giving him a reprimand and giving me a written apology. This is not the only complaint they have had about this janitor and I would like to know what course I as a concerned parent can take to rid our school of someone so obviously not good for children. To threaten a kindergartener is unthinkable, and has caused my son to miss a day of school for his fear, and nightmares. I would like to know if any legal action can be taken to get this man terminated.
 
You are exaggerating when you say that your son is being harassed and that is because, per your posting, it was a one time incident. Harassment is a repetitive thing. The school has taken disciplinary action. You don't have a legal case here.
 
You do have one other avenue of complaint, and that is the school board. If you know other parents whose children have had run-ins with the janitor, then you could all attend the next board meeting to air your concerns, or you could write a letter to the board.

They may just refer it back to the superintendent, or they may take further action. It depends on the relationship between the board and the superintendent.
