I have been on probation for almost 3 years now for Retail Theft (underringing).
Because of the amount it is a Class 3 felony. On my last court date state's atty entered a PTR (petition to prove) based on missed probation appointments as well as testing for cannibis on 2 different occasions. It was advised by my PO (probation officer) to get an evaluation for psych services and subtance abuse. Because of confict with work and other family issues it has been murder to get this done and the appointements are backed up. When I went to my court date for status 9/20/07 my bond was set @ 15,000. Im posted my bond and I am set for a hearing on 9/27/07. Then they will determine whether I should be resentenced or not. I only have a PD (public defender) at the moment but he says b/c i admitted to the aligations agianst me to revoke my probation.


Now im up for probation again possibly or 2-5 years in state prison?


This is a first offense and I have no priors?

CAN ANY1 HELP I WOULD DO ANYTHING B4 PRISON TIME.

AND IF U SAY STOP USING CANNIBIS I HAVE BUT THAT IS ONE OF THE FACTORS THAT THE STATE'S ATTY IS USING TO PTR.

The case is from 2004.

Wow, I hope the judge does not come down hard on you. Your public defender is just telling you that, based on guidelines the DA uses to recommend sentences of probation violators. Try to do all the tests and meet the requirements before your next appearance. Be nice and talk to your PD politely and beg him to plead for another chance…..PD don't really care much about their clients if they feel you are not repentant of your crime. So, be nice and work with him. A tough judge could give you hard time depending on the DA's recommendation. An understanding judge could warn you and give you one more chance which if you violate, would give you a harsh sentence. Another nice judge might give you a 30days time out in jail and put you back on probation……….It all varies from county to county depending on sentencing guidelines…………..Good luck!
