Help about gym membership

Hello Everyone,

I signed up with Bally without knowing what scum they were for a non contract based membership. They are promoting month to month with no signing a contract due to the recession. I would pay first and last month. Canceling has been the worst part after sending them a written notification and talking to customer service numerous times I was canceled. I am leaving the country for a bit and I need to close down my bank account. I am still waiting for my official letter to come and I am bound by time constraints. The Consumer's Council with the conjunction with the Attorney General's Office knows about my situation. They are in the process of filing my complaint and waiting for Bally to respond. Bally decided to over charge me for an extra month and they are trying to get a refund for me. My concern is if I do cancel my bank account would they be able to report this to a debt collecting agency? The only information they have a file is my debit card and my email. No contract with signed I did not initial or sign any documents.

I would send them a letter explaining the situation, the fact that you are leaving the country, and that you are closing your account. I would advise them that if you get back and there is a collection account on your credit you will sue. Any threat to sue goes to the legal department not the collections department. Keep your records and check when you get back. Good luck.
