help giving my son the real father he needs.

I have a 4 year old son, who's real father has never been in his life at all. He has been in prision since i was pregnant with my son. he is not release til 03\07. he is a register sex offender for molesting his daughter from a previous relationship. I am happily married woman with two beautiful children. my husband raises my son like his own and we have a child together, we are a family. my husband and i want him to adopt my son, but we don't know how to go about to do it? my son's bi-logical father would have to sign his rights over, but how tto a attempt that with an angry violent man, i know he would try to fight it to try to have some type a relationship with my son, but could he really do that knowing of his history of sex abuse, drug abuse etc. should i start this process now while his is in jail and where do i start? please help us!!! in our eyes we are already a happy family, i just want it legal and final, and i don't want this man in my son's life.

You need to see an attorney. You might be able to have his rights terminated based on the fact he is a sex offender, and for abandonment, but the courts will beed to terminate his parental rights so that your husband can adobt.
