Hello My name is Joice. On April 20th my husband had his identity stolen on Xbox Live. When the theif had stolen his identity he stole credit card information, account information and he has our home address. We had tried contacting Microsoft numerous times but cannot get anyone to help us. We where told that someone should be contacting up within 3-9 days from when the incident occured but that has not happened and it is going on 4weeks now. When I called on May 10th the manager had told me he is looking into it, but when I told him that I want a resolution now he hung up on me. When my husband called today he was told that no information in regards to all of our calls expect for the ones on April 20th and May 5th. This situation has put alot of stress on my family and we really need help. Can someone please tell us what legal action can we take?

Start with a call to the local law enforcement agency and then take it from there. This is something you should have done immediately. Waiting this long could prevent the case from being effectively investigated.

He should also check with all the credit reporting agencies to have a watch put n his credit, cancel or change any and all financial accounts that have been compromised, and contact his financial institutions as well.

Help Identity theft

We did contact our financial companies and notified them, but we did not contact our local athourities because microsoft will not give us any information to give to the authorities. They said that they want to investigate and handle it on their own and protect their consumers. They also said that if anyone else call they would give them the same information they gave us. Anymore advice? Please I'm welling to take it all.

Well, it is your choice, but unless you report it, you may be responsible for any financial damage.

Report the situation to the big three credit reporting companies, to your bank, etc. Unfortunately, your bank and any credit card holders will likely want a police report case number before they will reimburse you for any damages.

And even Microsoft would have to turn information over to the police if a subpoena is issued for that information.

If you do not want to contact the police, then you will have to settle for whatever Microsoft and others do for you. You can keep trying to get information, but understand that Microsoft is not likely to cover you for any damages.

Good luck.
