Is your son, Mom, over the age of 18?

Mom, I guess that would be YOU, should contact the police and inquire about getting your car back.

Your son, should keep his mouth shut.
If the cop had ANYTHING on Junior, he would not have let him leave without charging him!!!!
I mean, they weren't HIS drugs, anyway right?
His "friend" planted them on Junior, remember?
Therefore, he wouldn't know who to set up or where to get drugs, right, Mom?

By the way, Mom, don't let Junior drive your car again.
That is, if the cops don't keep it, because Junior doesn't use drugs and can't tell the cop what he demands to know!

This is actually quite normal for police to do... trying to turn small potatoes into big ones. There is nothing illegal or crooked about it. They were trying to make your son an informant. They tried to pressure him into the decision. How old is he anyway? Did he have a license to drive?

The old "he slipped his drugs into my coat" excuse is not an effective one. Your son was the driver of that vehicle and anything that is in it that is not claimed by the other occupants is his.

If the police found the drugs in his possession then there may not have been much valuable information that the needed in an interrogation as he likely denied ownership on the spot... depending on the questioning, informing him of his rights may not have been necessary. They can still forward the report to the District Attorney, and that is who ultimately decides whether to file charges. So... there may be a warrant in the near future.

All that said, I am guessing that the son is a minor and the drugs is marijuana... so it is more likely that the case is routed through Probation, and he was released because of the nature of the offense. Where I am at, I can issue a citation for possession of marijuana, but can not book anyone into jail for the offense unless they are carrying more than one ounce... which is quite a bit.
