Any legal advice would be greatly appreciated.
My husband and I seperated on August 16 after 3 weeks of marriage. We do not have children. He is employed full-time and he also collects SSI and SSDI. I am currently unemployed. We incurred over $30,000 in debt during and prior to our marriage when we were cohabiting. Most of the debt is in my name because I had better credit than him and a small number of debts have our names together. Very few bills are in his name alone. Though he was the one to walk out on the marriage and start the process of divorce, he is now asking me to pay half of bills for expenses that are his responsibility, such as a wireless phone bill which is soley in his name, and a gas card bill, and also expenses for hiring a moving truck to move our furniture out of the apartment we lived in. These were all debts in his name and done because of his actions.
I have taken on my share of the debt. I have not asked him for financial help. He has not offered support to me one bit in what we have that is in both our names, or my name alone. I now hear that he is seeking legal action and may take me to small claims court to get me to pay half of the debts in his name (about $500). I am out of work so $500 just isn't possible, plus I don't feel I should pay it! Do I have a case? Let me also mention, I have suffered emotional distress because of this situation. I am now unemployed but I was employed before our seperation. When we seperated I ended up in the hospital due to depression and anxiety, and have the hospital bill to prove it. It caused me to lose my job. I know Florida is a no-fault state. I am not asking for him to pay anything in my name. I may be declaring bankruptcy. I just don't want to pay for HIS debts.
