Hi! Good day. I would just like to seek your advice and opinion regarding my case. I've been married for almost 2 years now and it was just lately that I discovered that my wife was already married before using a different birthday under her name which is not yet annulled. Her mother was the one who suggested in using a different birthday since she was still underage at that time. Now my question is, what about our marriage? Is it still valid? I want to seek some advice first since we now have a 3month old baby. Does she using a different birthday before in her first marriage has something to do with the validity of our marriage since she used her real birthday on ours? I'm really confused right now. Hope you could help me on this. Thank you.

It depends on whether her first marriage is void or voidable under your state's laws. Both of you need to sit down with an attorney. This is very fact specific and only a family law attorney can really tell you. To prevent future problems you probably need to get a declaratory judgment from the family court.
