i'm 22 and i was cought shoplifting $15 worth of item from a store in Kansas and i have a court date set to appear. i really regret what i did and it was stupid. i don't want this to go on my record and affect my chances of getting a job or getting accpted to schools. i've read about diversion programs and how it can help. my question is, do i plead guilty or not guilty? and who do i ask about getting in to a diversion program?- the judge?... its my first time being in this kind of situation and i don't know the proper steps or what to do.... i know its a good idea to hire an attorney but i can't afford to hire an attorney at this time .so can i just do this with out one? would i be able to be granted the diversion program still with out an attorney? i'd really apreciate it if somebody can give me advices on what to do next. Thank you!

NO you dont just plead guilty. If you do that the Judge will then sentence you and its whatever Judge wants. You talk to an Attorney many if you can. Some offer free consultatons. Then when you go to court you and the Attorney (if you hire one) can deal with DA. If you don't hire one then plead not guilty and ask for Public Defender

Yes. Tell the Judge you plead not guilty and you would like a Public Defender

hi there, yap we all learn lesson in a hard way.

my advise on ur hearing...plead "i stand mute" so they will give u time to have a public defender..which i think its available when u are in court hearing(my friend had his hearing yesterday...the public defender is already there..that his 1st hearing too) his sentence is to pay $691, probation and 25days community service...which is good cz he was charge for felony grand theft (amount of $700) so yours is ONLY $15 dollars (petty theft) i assumed ur charges will be less...god i hope so. anyways just keep on praying...god do listen...god bless u buddy and learn the lesson.....goodluck

You can certainly say that but Judge will then enter "not guilty' plea in your behalf. Makes little difference. You are best to follow "assetprotection's" advice and consult some Attorneys first. They can advise you best

Thank u all for ur advise...now i'm getting a hang of it. i'll consult some attorneys and see what else they say. is there anything i should do ahead of time to be qualified for diversion program tho?

okay, i forgot to mention another problem, while the police was searching my bag for other possible items that might have been present, he found another item that i took from another store, $9 worth, but i lied and said i paid for that item and that i lost the receipt ( i know, not a good idea, i don't know why i lied, knowing that i'm already in trouble)...so he took me back to the other store where i said i bought the item from and asked the manager if she's seen me there or have sold the item, they checked the system and found out the item wasn't sold. (which is true , i was just so so scared to tell them the truth, i stuck to my stupid story) so anyways, the police and the manager told me to bring a reciept to them showing them that i paid for the item, until then the lady kept the item and wrote down just my first and last name on a piece of paper and they let me go. I didn't go back to the store or talked to the manager since then. so does anyone think the second store is going to charge me too? no one from the store contact me since then regarding the item, if the police officer put down this incident on the report, is it too late to admit? and am i still going to be qualified for Diversion?. its complicated now .wow...what have i put my self into...Well lesson learned tho.

Leave well enough alone. Theres a fair chance that other store wont take action since they have item and likely have no evidence of a theft. If it becomes an issue then deal with it. Right now do nothing
