Greetings,
An aquaintance received a Lane Violation ticket on I-26 in North Carolina driving a commercial truck. This is one of those where trucks are supposed to use the right lane and he passed traffic using the left lane.

1. Is it the case that a commercial driver cannot ask the court to PJC the ticket?

2. Can this be reduced to a lesser offence? What?

3. Can it be kept off the driver's record?

The driver is from out of state.
Thanks.

1. I doubt PJC is available to a commercial driver.

2. I'm surprised a cop didn't give him a warning. I would imagine that he can, if he goes to the court and talks to the prosecution, get a reduction in charge. Reduce it to failure to maintain lane, or unsafe driving for conditions, or better failure to obey a traffic control device.

3. Any of those will probably not be on his record. Check with an attorney for that.

Finally, this is his livelihood. Search for a local attorney, pay him $500 and he/she will do whatever needs to be done to get rid of the ticket so it doesn't affect his ability to make a living. Good luck.
