In June of 2006, a collection agency contacted me about a Citibank account of which I asked them to validate and received no response. I thought they would go away as these guys have 30 days to validate a debt. In January of 2007, I received a letter via certified mail by the Marshall's office that my account was frozen for $9,000 and that my wages were garnished. Me not knowing what to do and wanting them to go away, called and attempted to get the issue resolved immediately. I called the collections people, and they assured me that everything was fine and no further action would be taken. I specifically asked them if they would cease from going to my employer and they assured me of this-this occured on 1/9/07. On 1/26/07 my HR person approaches me and reveals that my wages will have to be garnished. Startled and embarrassed, I instantly dened the claim and informed her that I paid them and had to get on the phone with these people of which they gave me a hard time (both the Marshall's office and the Collection agency). It was as if this guy was belittling me out of spite. Eventually he decides to send the Marshall's office the proof that the bill was settled who in turn sent the info to my employer's HR dept. At the time I really wanted it to go away and didn't take any course of action. I wasn't informed that I was being sued and when I questioned this person about being served. He claimed that a brownskin man by a name I absolutely DO NOT know accepted the service notice at my address.
Now my dilemma is this, I received a call yesterday from the same debt collector referencing a Chase account that, according to my credit report-date of last activity was 2/2004. Anyway I do believe that this account was settled in 2005. I contacted the original creditor who gave me a number to a collection agency and I did also call that agency who said they no longer had the account and they also gave me another number whichI am in the process of sending these collectors a validation of debt. When I asked him if he could validate the debt his claim was that he was on the phone telling me now. I told him that I will need to verify some information and get back to him. His response was I need to hurry up because I may only have a few weeks before they begin legal proceedings against me and his comment was, "and you know how that is". I really need to know how to approach this situation where these guys don't attempt to try their dishonest tactics. In addition to sending them the validation letter via certified mail, is there something else that I may file with the court's office where I can be notified if these guys attempt any legal proceedings without notifying me?
Also if anyone can refer me to an attorney so that I may sue these guys because I am at wits end with these guys.
