I need some help with what to do with a citation for failure to drive in single lane. I Reached the blind crest of a hill on a farm road north of plano, tx with cruise control set to just below speed limit of 50 and foot covering brake, to suddenly see a spare tire in the middle of my lane on mounting the crest. Split second option to either hit tire and damage car for certain or swerve to avoid it and resultingly move into other lane (1 lane each way painted markings). I swerved and this resulted in me skidding and rolling the car 2 - 3 times, totalling it in the process and landing upside down 20 yds from the opposite lane of traffic to my progress in the grass. Pulled self from car with help of passersby and was issued with a citation for "failure to drive in single lane". Do I have any legal recourse for this on the grounds of foreign object in roadway impeding my progress or the such? I made sure the attending officer (1 of 5 stopped) noted the tire in his report, but he claimed that I would be unlikely to win in court. Your opinions would be highly helpful.
Also does anyone think that I would have any chance of returning the value of the car from the city due to a (potentially) unsafe roadway, as it was only insured for liability.
