Help with Property Distrubution in Texas

My dad and step-mom are getting divorced although no formal separation has been filed yet. They moved to Texas from Michigan about a year ago and purchased a home. There is approximately $50K in equity in the home. My step-mom is going to stay in Texas and keep the house. My dad is moving back to Michigan. In order to avoid refinancing the house to get the equity out of it, my dad offered to take his newly purchased truck that is in my step-mom's name and have her continue to make the payments until it is paid off and then transfer the title to him. However, none of this is in writing yet. He is planning to ship the truck this week. I'm concerned what the legal implications could be, if any, if he ships it and she changes her mind? Could she report it stolen and if so, would it be on valid grounds? Would my dad be charged for this offense?
