Help!

my husbands mother passed away without a will~he is the only heir...he is a state jail facility...his aunt tried to jump in with her attorney and take over with this trust set up for my mother n laws estate and business...my husband is the only one who can sign it for her to be a trustee...all he wants is the "affidavit of heirship" papers...the attorney backed out so did the aunt~WHICH IS GOOD!....i have been living in the house for six months now...pretty much him and i have no money for a new attorney..well my mother in laws business partner owes her some money, which goes to my husband, but we don't have a lawyer to negotiate with him....also, my husbands aunt was meeting with my mother n laws partner secretly making deals with him....i am not sure what to do at the point..one attorney i met with advised me to just wait until my husband gets out....that is fine, it gives me enough time to save up some money...the only problem is i donot want my husbands aunt pullin something sneaky...the house and money is my husbands regardless, but i heard about this "administration" thing....she could end up doing that....where do i go from here or do i need money straight up....we were gonna pay all attorney fees with the money from the business partner, but i don't think lawyers do things like that

Perhaps you are talking about administration of the estate, where the administrator is entitled to some type of fee. You may want to keep a very close eye on what is going on. Let's discuss possibly the most important question -- did your late mother in law have a will?

no she did not...my husband is the only child and his dad passed away back in '98...my mother told me something about "legal aide"...i don't know...my husband and i are both broke, at the moment....and like i said he is in a state jail, here in Texas....i have been living in the house since October 2006....my mother in law did not sign anything concerning this...my husbands aunt just thinks that my husband is some "flipped out druggie"....his whole life they have never cared about him...of course now they backed out in "trying to help us", b/c i caught onto their sneaky game...i may be young, but i am not stupid....she is or was trying to steal this house from us....i think she could do something like file for administration for the estate, that is the only thing i am scared of...
