My husband and I moved ot of this house because we could no longer afford it. The landlord is wanting us to pay for both November and December. We have agreed to pay November but we don't think we should pay for December because the landlord did not take care of the property. For example, it rained for a week and the basement leaked creating about 2 inches of water. We called the landlord and they informed us that there was nothing they could do the house is old and the foundation is cracked. There was mold growing down in the basement and every time we ran the air conditioner we would have to breathe in this horrible smell. Second of all my daughter was bit by a spider and we contacted the landlord she had a company come and spray but also informed us that she was only paying to have them do this once. Needless to say we still have a lot of spiders. Is she in fact in breach of the contract and if so do we have to pay Decembers rent. We no longer live in this house.

If you expect to live there in December, you have to pay the rent.
 
Is my landlord in violation of the lease if they do not take care of spider infestations and mold in basement?
