I have a question regarding the rental unit where my wife, child and I live.
The apartment is in San leandro CA
On November 20 of 2007, there was a leak coming from our bedroom ceiling which was directly over our bed. We'd called the apartments managment center and they didn't get back to us until 3 o 4 days later. At the time the inspector from the company when to check out the situation. We were told that they would return in about a week hoping for the leak to stop by that time. The leak did stop however and no one ever returned or call to do a follow up.
My wife and I stop using that portion of the room, as we were afraid that the leak might reoccur. We were hoping that they would located the source of the leak before our baby's March 19th due date.
It appeared that the management company had forgotten about us and we were not as concern about that at the time since we were dealing with a newborn. The leak appeared again in June and once again we called the management office. They seemed annoyed with us, and told us to fill in some sort of form requesting repair. After a few more weeks of being given the run around and spoken to rudely, they finally set a time for someone to come to our apartment in July. The superintendent opened a hole in the ceiling, could not locate the leak and was told that we would have to wait for the leak to reoccur. Now we are living with a hole in the ceiling covered with plastic garbage bag and unable or afraid to use that portion of the bedroom.
After sending them a letter with photo threating to take them to small claims, they finally set a schedule to locate and fix the leak. We asked them for a reasonable compensation for the damaged brand bed, our not being to use that portion of the room and for aggrevation. They offered us $150.00 of which I refused.
Do we have a small claims case? Can they legally evict us if we file small claims and what would be a reasonable small claims amount?
