Please,

Someone answer me regarding earlier post. I co-signed for my daughter for a one year lease however she re-new the lease for another year (i did not signed the renew lease) the land lord want to evict her and they he is threatening to report the eviction on both of our credit reports. I am trying to refinance my house and don't need anything negative on my report. Can the land lord do this even through i did not sign the second time?
 
In some cases, when a lease ends, the tenant automatically goes on a month to month basis. In that case, the stipulations of the initial lease still hold.

However, if your daughter actually signed a new lease and you did not again co-sign it, you would play no role in this eviction.

A landlord cannot actually evict someone; only a court can grant an actual eviction. When a person receives a notice that an eviction has been filed against them, they have a certain amount of time (varies between states) to respond to this notice.

If they do not respond, the eviction is granted to the landlord. If they do respond the next step is a hearing where both parties can present their sides on the matter.

When your daughter receives this notice, it would be to her benefit to respond to it and for you to attend the hearing with her to make sure it's legally documented that you are not a co-signer any longer on this lease.
