my brother and his girlfriend have a no contact order. They live together and have a little girl. He is on the lease to the home they live in, she is only listed as living there. Who has to leave the house? If it is her how can he keep her out? The order forbids him from contacting her, what if she is the one bothering him?
 
He is the one that has to leave. She has every right to live in her residence and because he has a no contact order his rights have been curtailed. Regardless of who is bothering who, your brother will go to jail if there is contact. Further if he violates a court ordered no contact provision he can be charged with Felony Aggravated Stalking that is a very serious offense.

The order does not regulate her contact with him, only his contact with her. He is not allowed to have contact with her EVEN IF SHE INITIATES IT. Until this matter is cleared up he needs to stay away from her. If he needs to get his things he needs to apply to the Judge to do so.

PS: Since he has a no contact order, some amount of violent or threatening actions have taken place. They don't issue no contact orders otherwise. So your brother, though I'm sure you are on his side, is not completely innocent in this. I would advise him to handle this carefully or he will be in jail.
