today, my stupid kids shoplifted from a mall in san jose. one kid stole $915 worth of stuff and my other kid stole about 700$ but neither of them damage anything in anyway . the kid that stole 700 already been caught stealing 2 years ago at sears. what is the worst and best thing to happen to these kids?

Both kids need Lawyers and ASAP!. The amount stolen takes these thefts into felony levels!! Jail is very real possibilty!! They will have a criminal record that will follow them for life!! Diversion will not likely be available in either case but one with priors for sure. This is very serious and you should start calling Lawyers right away!! It would probably be helpful if both children enrolled in an Anti Shoplifting course before court! This will show Judge both reomorse and action on their part which could help Judge decide on lighter sentence. We can recommend such a course if you like.

but these kids got caught before they were even able to leave the store. and the employes said that they could put all the clothes back on the shelves

If the police were not called, then a criminal record is not likely.

However, a civil demand is still possible. Pursuant to the Penal Code the store could demand a civil compensation of upwards of $500 to help compensate for the cost of restocking, security, etc. even if no charges are filed. No, it does not have to be a direct compensation of their costs. The typical request is about $250 to $300. If this were MY child, she would be paying me back for a long time, and would be grounded for life (or near to it).

I hope that there are some severe punishments awaiting her at home.

Did they use tools? Bags? This might effect what happens too.

all they used were bags and the police were called. the police just worte a citation for both of them and said that we would get a letter w/ our court date in the mail

The charges can be commercial burglary (a felony) and/or grand theft (also a felony).

They need attorneys ASAP.
