My friends father has threatened to take me to small claims. My friend came to my home one night in the summer drunk. In his possession, he had a skateboard. As he was attempting to leave without his skateboard, I offered him a ride home as he was too drunk to walk or ride. He left the skateboard at my home and left. It stayed at my home for more than 1 month. I had asked him on numerous occassions, to get his skateboard by phone, texting, and facebook messages. He has failed to get it. Another friend who happened to be at my home offered to return it to him. It appears that this other friend failed to give it to owner but instead he gave it to a 3rd person. This 3rd person now refuses to give it back to the owner and had even fought.I have tried to reason with this 3rd person and he still refuses. Now the father of owner is calling my home threatening me. I am 17 yr old female and I am worried and confused about the legality of suing me or getting my parents involved, would my parents have the responsibility of replacing this skateboard. The skateboard is more than 1 year old and in poor condition and cost 150.00 at time of purchased. I am anxiously awaiting your response.

Relax, small claims is NOTHING.

You are a minor.

You can NOT be sued in small claims.

You can't be sued anywhere!

Why?

You're a legal incompetent.

The REAL incompetent is the father of the idiot that left the skateboard at your home.

Don't tip your hand about being too young to be sued.

Let time pass, and this will, too.

Can he sue your parents?

Sure, he can sue Queen Elizabeth (in the US) and even Presidents Obama, Clinton, Carter, Daddy Bush, and Junior Bush.

Of course, such a frivolous suit is small claims would fail!

If he sues your parents, he'll be surprised, they aren't liable for this circus of clowns!

But, don't run your mouth about that either.

In fact, you'd be better off avoiding them all, or NOT talking about this with any of them!

Ignore your friend's father. Do not respond to silly threats.
His son is the only one responsible for that skateboard.
The skateboard hasn't been stolen. Nobody has anything to worry about. It will cost more to sue than it will to just replace the skateboard... however dad should have some sense and not replace the dumb think so his son can learn a little something about responsibility and underage drinking.

eber719 - Here is my best advice to you. PLEASE READ THIS IF YOU RECEIVE IT.

1. If you were "anxiously awaiting" replies and decided to report our notifications to you to AOL as spam numerous times, please undo this immediately and reverse the spam setting. Reporting us as spammers creates problems for everyone. If you want to unsubscribe and not receive notifications, the email clearly states that all you have to do is click the link and no more notices will arrive.

2. I hope that you were less impulsive with the skateboard issue than you were with our email system. Others have it correct above. If they take you to small claims court, you shouldn't have much to worry about. Tell daddy to sue the third party in possession of the skateboard.
