Last weekend, my brother came up to visit at college homecoming. He's 26 and im 18. He ends up taking me to his friends house where he follows gets extremely intoxicated. Him and his friend decide they wan to go pick up stuff from the store and i refuse to let him drive. I offered to drive him to down the block and back. At the stoplight a cop pulls up behind us and as we proceed in to the parking lot he turns on the lights. He comes to the window and tells me i have a bad licence plate and/or tabs. This is not my car or my brothers, its his friends and no one told us this. hes sees my brother drunk and asks me if ive been drinking and if he could take my BAC. I nicely accepted and blew a .03% I had literally sipped half to 3/4's of a beer because i didnt feel like binge drinking so i held it in my hand at the party to not feel as akward about not drinking. I didnt think it would show up on a breathylizer (by the way i only way 114lbs). they give my a sobriety test which was overly simple because i didnt feel the affects of any alcohol. I got a ticket for "minor exhibiting in a public place". I consider myself lucky for not getting a DUI but i was also only .01% higher then the .02% BAC legal limit for anyone under 21 in Washington.

So what can I do? My parents are offering to pay for a lawyer because in some way i was doing the right thing and it was for family. Needless to say they arent happy with my brother. I just dont know if its worth arguing so I'm coming to you for expert legal advice.

By the way, I didnt recieve any tickets for the licence plate, or not having my license on me at the time. They just had me park the car and walk off.

Get advice from a traffic lawyer to see if you have a good chance of fighting the charge and succeeding, in that county. The cops seemed to have acted professional and even a bit lenient. We can't tell your chances or best option without all the facts and knowledge of the way your county handles such cases...........we don't know what type of deals are done there. It varies from one county to the other. If your parents are offering you a lawyer, the use him for more accurate advice per your county...........
