Hired Web Developer for a PHP script... No script

I hired a web designer in Utah to write a script for my website, He gave me a proposal with a deposit amount. He quoted $125 / 3 days.
I paid him $85 as a deposit over a month ago, won't reply to emails, or phone calls.
What can I do to legally get my money back?
I have all emails and proposal.
Would court be in FL or Utah if I were to sue?
I hate to sue for a small amount, but its more of the principle.

Looks like this guy clipped you.
You'd have to sue him in Utah.

It would be very hard to serve him in Utah to answer to a suit in Florida.
In fact, it would be impossible in a case for such a nominal amount.

Before you bring a small claims lawsuit, you have to pay filing and service fees.
In Utah, the filing fee is $60.00.
But, then add in your travel costs.
You can readily see this is a financial no brainer!

Principle or not, it'll cost you more than you could ever collect to pursue this.
Next time, hire a local person.
Its a lot safer.
You also never pay until you approve the work.
