About two and a half months ago, my husband hit a parked car. Our insurance and their insurance took care of repairing their car, but now the owners of the car we hit want us to pay for their car rental b/c their insurance wouldn't pay for it! Are we obligated to pay for their car rental? Or is it an expense that they are going to have to deal with because they didn't have the option on their insurance to get a rental car? What are the laws on this?

I don't feel we have to pay for thei car rental b/c they were not forced to get a rental car. It was an option. They could have just borrowed a car from someone or dealt with the one car they already have...

I just don't want have to get a lawyer and pay attorneys fees when i know attorneys fees would cost more than they rental payment itself.

Thanks for all your help.

Are you serious? How do you know they didn't need the second car? Were you in a position to loan them a car? Why should they be inconvenienced because your husband damaged their car?

If you don't pay it, then they probably WILL take you to small claims court. You'll lose a day of work, and the attorney fees. Hard to say if you'll be ordered to pay for the rental, but you'll already be out a fair amount of money even if you aren't.

Turn the claim over to your insurance company and let them deal with it. That is why you pay those high premiums.
