hit and run - then the driver sues me

:mad:On Jan 5, 2010 I got stuck in a right hand turn lane = there were two roads heading to where i needed to go - I was near an airport and it was about 9:30pm but not much traffic - it is heavily policed however due to airport - i looked back and there was one car in the far left road - i barely had gotten the nose of my camry into the inner lane (i did have my directional on) then the young lady had switched lanes and clipped off my driver whole bumper area - she got out of her car and the first thing she said was "I wasn't speading - you just popped up in front of me" - I usually always have my ins info written down so i was just adding my name and ph number - she gave me only her name and phone number and told me she had to go , did not have her lic w her - had jusst run out of house to get someone some medicine - I asked for her ins - she ran around to passenger side of her car - gave me a card and took off - when I looked at the card it was the card that is supposed to remain in the car - it was registered to someone else with no collision coverage - I was later shocked to find out it was a 2005 Camry because you could not tell due to all the rust - mine was a 2001 and i had collision - a police officer pulled up behind me and remained there until my husband and tow truck got there so I would not be rear-ended - this officer failed to file a crash report. According to the DMV, there was no accident on Jan 5 as there was no police report nor record of crash - one week later, I was notified by my insurance company that this girl was suing me for soft tissue damage - one year later and still that is the only info they have - the car it turns out resides about 40 min from where this happened and my guess is that it being airport area, this girl was drinking and that is why she wanted out so fast as it was less than a minute before officer appeared - my july premium for ins was 377.00 - they billed me in Jan for 882.00 reason being they stated I was 100 percent at fault for the accident - I went to the police department and they advised me to file suit against my insurer because they never heard of such a thing and as there was not even a record of this accident they were basing it solely on this girls recorded statement - I did report to mine and when I described , they initially told me that if police had been there it prob would have been a 50/50 culp negligence -- I do not understand how they can state I was 100 percent responsible - how do I know this girl did not run into 3 more people on her way home and then take off?? Also very convenient that her attorney happens to have an "in house" nurse who is also his wife - any ideas?? Before I filed complaint on Amerprise (IDS) they asked me well did I want to file a counter claim - at this point it would be for pure emotional stress........

Speak with an attorney, ASAP.
Inform your insurance company, ASAP.
Admit to nothing.

Never leave the scene of any accident (next time) without calling and waiting for the police.

This sounds like the work of a professional insurance scammer.
They cause accidents and then sue innocent people like yourself.

Speak to an attorney and say nothing except to the attorney.,
Then plot your next steps with proper legal advice.
