HOA exterior painting

We've repainted our house but didn't used the approved paint panel from The HOA or Architectural Committee.

4 months later we have received a letter from the association that a permit has to be requested for the painting improvement to our house.

We were very upset since several of our neighbors in the same period of time have re-painted their house without the committee approval color scheme. In 2002, my next door neighbor and I have verbally asked the association about any color specification to re-paint our house. We were told that it does not matter what color as long as the neighbors were in agreement with the upgrade. That neighbor has re-painted his house without any problem.

We have chosen the color based on a model home picture from the Lowes painting pamphlet. Before taking the final decision on the color, we have been driving around the community and found out many houses with the same color than ours. We have also found out that a huge percentage of the houses have been painted without the approved paint panel.

We understand that the visual appearance is important to ensure that the value of the properties in our community remains at the highest level possible. Obviously, we've upgrade the painting of our house considering that very important factor by picking a model house color in a magazine and by looking around in our neighborhood.

Following the HOA letter, we have met the facing and adjacent neighbors and they all have agreed with the upgrade and signed up.

Here we are a 1 1/2 year later, after going back and forth with the HOA; We've received a final notice to paint our home to the original color.

Does the HOA has the right to make us repainting our house taking in consideration that our neigbors have approved the color?

What type of action the HOA could be taken against us by refusing to repaint the house?
 
Can you attain a copy of an HOA handbook that lists the bylaws for your specific community? What do they say? That's where I would start!
 
They have sent a memo with the monthly bill several years ago about the exterior painting policy. Unfortunitly we didn't see it since we pay our fee online we don't take attention of the memos coming every month. Does the HOA can force a rules like this even if the neighbors has agreed on the colors?
