I have been assessed a $280.00 fine by my HOA for not keeping my garbage can inside the garage.
My issue with this fee is I moved into my home in April of 2001. My garbage can sat in the same spot for 6 years as did many others inside the fenced in courtyard. I never EVER received a notice that I was in violation of any "Bylaw" for 6 years.
I then did begin receiving notices asking that I bring the garbage can inside, but because of smell I chose to leave it outside in the same sport, the notices did not mention any fee being charged. However I have now learned that the letter stated there was a daily fee being charged.
When I received the letter telling me that I was charged for leaving it out after 6 years of having it in the same spot I immediately brought it in and expressed to the association that I felt I should not have been charged a fee as the rule was not enforced for 6 years.
The issue has now been sent to an attorney and in addition to the $280.00 fee I am also being charged the attorney fees and interest which total approx. $700.00
I have now agreed to pay the $280.00 and have asked that the issue then be over. I am being told that I have to get a mediator if I want to dispute any of the fees.
I just want this to go away. HELP!!!
