HOA Leasing Approval -- Lack of Approval Parameters

I recently called my HOA's management company to request a leasing request form or packet and to find out the procedure for getting their approval on leasing my home. I was told no such form existed. That I should just send an e-mail requesting the approval along with the appropriate documentation. I asked what documentation was to be provided and was told that whatever I thought was appropriate.

This seems a little vague to me and perhaps sets the homeowner up for failure on getting an approval. It also allows the HOA to receive more information than necessary if the documentation you provide is too much information and could be considered an invasion of privacy (i.e. unnecessarily providing bank statements, w-2s, tax records, etc.).

My questions include :dunno: :

1. Can they legally make a decision on whether I can rent out my home considering they do not have an official written policy in place or address in the CC&Rs the procedures and parameters for determining hardship of a homeowner?
2. Since the submittal procedure is so vague, what would be my best next steps on making this request process a success?

Sidebar/Insight on Leasing Decision:

My husband was fired and we are moving for a job opportunity since there are non for him currently here. We don't feel that it would be smart for us to sell our home in this market considering we bought at the height of the market and are currently upside down in our home by at least $100,000. We also consider AZ home and plan on moving back to our home in a couple years and would rather not sell. We feel that a renter would be the perfect option for us considering the market, current financial situation, and the fact that we plan to return to the area. Is that a hardship???
 
Does the CCR's of your HOA have a restriction on whether or not you can lease your property. If the original CCR's do not have such a restriction, they do not have the authority to do so.
